Content Protection for BD-ROM Version 2

As Content Protection Obligation of FLLA for BD-ROM (Read-Only), following requirements are defined.

 

1. Definitions

“AACS” shall mean the content protection system called “Advanced Access Content System” for managing content stored on the next generation of prerecorded and recorded optical media for consumer use with PCs and CE devices.

“AACS Online” shall mean application program interfaces and functions described in Chapter 4 “Details for Uses of On-line Connections” in the version 0.92 or later of “Advanced Access Content System Blu-ray Disc Pre-recorded Book.”

“Online Certificate” shall mean a certificate to be issued or that has been issued, by the BDA to Type B Licensees under BD-Live Logo License and Online Certificate Issuance Agreement, the semantics of which are defined in “Certified Network Connection” in 3-2 Annex DD in “System Description, Blu-ray Disc Read Only Format Part 3: Audio Visual Basic Specifications: version 2.XX.”

“Online Certificate Verification” shall mean function to verify in connection with an Online Certificate that was duly provided by BDA certificate authority and has not been revoked.

“BD-ROM Mark” shall mean the technology which is described in the “3C BD-ROM Mark Specification.”


“BD+”
shall mean the technology which is described in the “BD+ System Specification.”

New Production Format Model” shall mean a First or Next Production Format Model which is released after a certain date.

 

2. The Selected Content Protection Systems in this Agreement are the following systems (collectively called “CPS”):

BD-ROM MARK
BD+

3. Licensee shall implement and cause its Licensed Affiliate(s) and any applicable subcontracting third party(ies) to implement CPS in its BD-ROM Products in accordance with the following CPO Table and CPS license. For the avoidance of doubt, “Not Required” in the CPO Table means that it is Licensee’s choice whether it will implement such CPS or not.  For the further avoidance of doubt, BD-ROM Game Media should be compliant with Content Protection Obligations applicable to BD-ROM Game Media in the CPO table and not the Content Protection Obligations applicable to BD-ROM Data Media.

 

4. Licensee shall ensure that each BD-ROM Movie Player and BD-ROM PC Drive is not allowed to playback any BD-ROM Media (excluding BD-ROM Media whose data capacity is 4.7 or 8.5 Gbytes and BD-ROM (Hybrid) Game Media) unless such BD-ROM Media (excluding BD-ROM Media whose data capacity is 4.7 or 8.5 Gbytes and BD-ROM (Hybrid) Game Media) includes BD-ROM Mark.  Beginning May 22, 2008, (i) New Production Format Models of BD-ROM Movie Players and (ii) a combination of a New Production Format Model of BD-ROM PC Drive and any BD-ROM PC Application Software will be subject to verification of compliance with the applicable portion(s) of the most recent version of the Test Specification pursuant to Schedule B.  After a twenty-four (24) month grace period starting from February 22, 2008, (i) the portions of New Production Format Models of BD-ROM Movie Players that are responsible for detecting and responding to the absence of the BD-ROM Mark and (ii) the portions of a combination of a New Production Format Model of BD-ROM PC Drives and any BD-ROM PC Application Software that are responsible for detecting and responding to the absence of the BD-ROM Mark will be required to comply with the compliance and robustness requirements of Schedule H.

 

5. Licensee shall ensure that each BD-ROM Game Console manufactured by Licensee does not play back any BD-ROM Game Media (excluding BD-ROM Media whose data capacity is 4.7 or 8.5 Gbytes) unless such media is protected either by its own proprietary content protection system or BD-ROM Mark.  As of the expiration of ninety (90) days period from the announcement on BDA website by Licensor of the availability of all applicable test disc(s), New Production Format Models of BD-ROM Game Consoles will be subject to verification of compliance with the applicable part of Test Specification pursuant to Schedule B.  After a twenty-four (24) month grace period starting from February 22, 2008, the portions of New Production Format Models of BD-ROM Game Consoles that are responsible for detection and response to the absence of ROM Mark will be required to comply with the compliance and robustness requirements of Schedule H.

 

6. Licensee is allowed to manufacture any BD-ROM Component which supports multiple CPS as long as it is in compliance with the CPO table. For example, Licensee may manufacture the BD-ROM Component which supports both AACS and BD-ROM Mark.

 

7. Beginning November 16, 2006: (i) New Production Format Models of BD-ROM Movie Players, and (ii) a combination of a New Production Format Model of BD-ROM PC Application Software and any BD-ROM PC Drive will be required to reject the playback of Media that (a) incorporates Commercial Audiovisual Content or other audio and/or video content which has been encoded in accordance with the “System Description, Blu-ray Disc Read Only Format 2.0 Specifications part 3” and (b) do not implement applicable AACS files as specified in “Advanced Access Content System (AACS), Blu-ray Disc Pre-recorded Book”.  As of the expiration of ninety (90) days period from the announcement on BDA website by Licensor of the availability of all applicable test discs, (i) New Production Format Models of BD-ROM Movie Players and (ii) a combination of a New Production Format Model of BD-ROM PC Application Software and any BD-ROM PC Drive will be subject to verification of compliance with the applicable part of Test Specification pursuant to Schedule B.  After a eighteen (18) month grace period starting from February 22, 2008, (i) the portions of New Production Format Models of BD-ROM Movie Players that are responsible for detecting and responding to the absence of applicable AACS and (ii) the portions of a combination of a New Production Format Model of BD-ROM PC Application Software and any BD-ROM PC Drive that are responsible for detecting and responding to the absence of applicable AACS will be required to comply with the compliance and robustness requirements of Schedule I.  For the avoidance of doubt, the compliance and robustness of all implementations of applicable AACS in BD-ROM Players, BD-ROM PC Application Software and BD-ROM PC Drives shall be governed at all times solely by the terms of the applicable AACS license(s) and not by Schedule I.

 

8. Subject to the following sentence, no later than 18 months from February 22, 2008 (i.e., August 22, 2009) (“AACS Online Grace Period”), Licensee shall ensure that AACS Online and Online Certificate Verification is implemented in each BD-ROM Movie Player, BD-ROM Game Console and BD-ROM PC Application Software which complies with “BD-ROM Profile 2” as specified in the “System Description, Blu-ray Disc Read Only Format Part 3: Audio Visual Basic Specifications: version 2.XX.  Notwithstanding anything in the foregoing sentence to the contrary, Licensee acknowledges and agrees that, if Licensee hereafter enters into a BD-Live Logo License and Online Certificate Issuance Agreement, the AACS Online Grace Period shall expire immediately as of the date of such agreement, such that any BD-ROM Movie Player, BD-ROM Game Console or BD-ROM PC Application Software which complies with “BD-ROM Profile 2” as specified in the “System Description, Blu-ray Disc Read Only Format Part 3: Audio Visual Basic Specifications: version 2.XX and carries the BD-Live Logo must also implement AACS Online and Online Certificate Verification.
